Pennsylvania Motorcycle Laws
To operate a motorcycle in Pennsylvania, you must first apply for a Class M permit and then take a knowledge and skill test to earn your license. To learn more about this process and to view a sample test, check out the Pennsylvania Department of Transportation (PennDOT) Motorcycle Operator Manual, or click here.
Motorcycle Protective Gear Laws and Recommendations
Protective Eyewear Law:
Protective eye gear is required for all riders. It is highly recommended that you wear shatter-proof eye protection, however, any type of protective eye wear will keep you in compliance with Pennsylvania law.
Pennsylvania Motorcycle Helmet Law:
Pennsylvania motorcycle helmet law requires any person who operates or rides a motorcycle must wear protective headgear unless:
- They are at least 21 years of age and
- They have either two years of motorcycle riding experience or they have completed a motorcycle safety course approved by PennDOT or the Motorcycle Safety Foundation
To ensure that you are complying with state law, check that your motorcycle headgear meets the standards approved by the United States Department of Transportation by looking for a “DOT” sticker on the helmet.
While it may not be a requirement for all Pennsylvania motorcyclists to wear a helmet, protective headgear can protect you from sustaining serious head, brain, and neck injuries in most cases.
We also recommend wearing full protective gear while riding, such as motorcycle jackets and gloves, as these can protect you from road rash and other injuries. It is also important to note that operating a motorcycle under the influence of drugs or alcohol is illegal.
What Is Lane Splitting?
Lane splitting is the term used to describe the act of driving a motorcycle between two lanes of traffic traveling in the same direction.
Is Lane Splitting Legal In PA?
Though many motorcyclists regularly drive this way and the safety of this practice is constantly under debate, lane splitting is illegal in Pennsylvania.
Motorcycle Accident Liability
A motorcycle accident can have numerous causes. A biker may crash because another motor vehicle failed to see them before changing lanes, or because they ran over a pothole.
A crash may also occur due to inclement weather or fatigue. Each wreck is different, a fact we take into consideration every time we take a motorcycle accident case.
If your crash took place due to the negligence of someone else, you have the right to sue that individual or organization for damages. Damages include any losses you have suffered as a result of your accident, such as medical expenses, lost wages, motorcycle repairs, and pain and suffering.
We will help you hold the party liable for your accident responsible. Examples include:
- The driver of another motor vehicle, in case a motorist hit your motorcycle while driving recklessly
- The motorcycle manufacturing company, in cases involving a crash caused by a defective part
- The city or state government, in the event that a poorly designed road caused your accident
The examples above are by no means comprehensive. We will listen carefully to the facts of your case to help you identify the specific cause of your accident. Then we will collect evidence on your behalf that proves who or what was responsible for your motorcycle wreck.
